جرائم المساس بنزاهة الامتحانات والمسابقات -دراسة تحليلية في ضوء الأمر 20/06 المعدل والمتمم لقانون العقوبات الجزائري

Abstract

أمام قصور العقوبات الإدارية والتأديبية المقرّرة لمجابهة أعمال الغش التي تطال الامتحانات والمسابقات وتمس بنزاهتها ومصداقيتها على جميع المستويات وعدم فعاليتها، والدليل على ذلك تزايد حدّة الغشّ وتعدّد صوره، وفي ظل غياب نص تجريمي مستقل يعاقب على مثل تلك الاعتداءات. تدخّل المشرع الجزائري وجرّم بعض الصور من تلك الاعتداءات الماسة بنزاهة الامتحانات والمسابقات على إثر تعديله للأمر 66/156 المتضمن قانون العقوبات بموجب القانون رقم 20/06 الصادر بتاريخ 28/04/2020 الذي استحدث نصوص المواد 253 مكرر 6 إلى 253 مكرر 12 المتعلقة بجرائم المساس بنزاهة الامتحانات والمسابقات محددا بمقتضاها صور تلك الجرائم والعقوبات المقررة لها. الكلمات المفتاحية: الامتحانات والمسابقات؛ جرائم؛ النزاهة؛ المساس. Abstract: In front of the ineffectiveness of administrative and disciplinary penalties prescribed to confront acts of cheating that reach exams and competitions and affect their integrity and credibility with ineffectiveness at all levels, the evidence for that is the increasing intensity of adultery and its multiple forms. In the absence of an independent criminal text punishing such attacks, the Algerian legislator intervened and criminalized some forms of these attacks which undermine the integrity of exams and competitions, after amending Order 66/156 containing the Penal Code under Law No. 06/20, which was passed on 04/28/2020, eliciting the texts of Articles 253 bis 6 to 253 bis 12 related to crimes of compromising the integrity of exams and competitions, specifying the forms of those crimes and the penalties prescribed for them.
