Abstract

"ملخص تمحورت هذه المذكرة على دراسة التحكيم في الشقاق بين الزوجين، إذ أنه يعتبر من المواضيع بالغة الأهمية في المجتمعات الإسلامية، لما له من دور في حماية الأسرة من التفكك الناتج عن الفرقة الزوجية، إذ أنه من الإجراءات التي يتعين على القاضي انتهاجها قبل الفصل في الحكم بانحلال الرابطة الزوجية، وإلا كان حكمه عرضة للإبطال, إذ أثار هذا الموضوع جدل فقهيا أثر على موقف رجال القانون في مختلف التشريعات العربية، حيث أن المتأمل في قوانين الأحوال الشخصية لهاته الدول يجد أنه هناك من نص صراحة عن هذا الإجراء وهناك من ذكره ضمنيا. وهو ما بيناه بنوع من التفصيل من خلال دراسة مقارنة في الفقه الإسلامي وقانون الأسرة الجزائري وبعض تشريعات الأحوال الشخصية العربية.
