نظام الرخص كآلية للتداول المستدام للنفايات الخطرة في الجزائر

Abstract

عتبرنظامالرخص،بمثابة أحد التدابيرالقانونية والوقائية الذي تتخذهالإدارة المكلفة بحماية البيئةبغرضضمان الرقابة المسببقةعلىكيفية تداول وإدارةالنفايات الخطرة، بدءا من مصدر إنتاجها إلى غاية التخلص منها بطرق سليمة بيئيا.ونظرالطبيعتها وبفعل مكوّ ناتها المحتوية على المواد السبامة والخطرة، حيث تتطلب الحذر الدائم والمسبتمر عند التداول.هذا ما جعل المشرع الجزائري يكرس هذا النظامكإحدى أهم الآلياتالقانونية للتداول المسبتدام للنفايات الخطرة فيمختلف النصوص القانونية. ولأجل ذلك أصبح من الضروري على كلّمهتمبمزاولة نشاط الجمع والنقل، إضافة إلى المعالجة ّ والتخلص من النفايات الخطرة، الحصول على ترخيص رسمي من الوزارة المكلفة بحماية البيئة، بهدف تحقيق أبعاد التداول المسبتدام للنفايات الخطرة، والم ّتمثلة في البعد البيئي الاقتصادي، الاجتماعي والتكنولوجي، معالتركيز على البعد البيئي الذي يعد كأولوية في الوقت الحاضر بالنظرإلى خطورة هذا الصنف من النفايات على البيئة وصحة الإنسبان. The licensing system is one of the legal and preventive measures taken by the Department in charge of Environment protection to ensure the prior control of how hazardous waste is traded and managed from the source of its production to its disposal in an environmentally sound manner. Because of its own nature, its toxic and hazardous components, it requires constant and continuous caution when trading. This pushed the Algerian legislator to devote this system as one of the most important legal mechanisms for the sustainable circulation of hazardous waste in various legal texts. 27111012702912020 It is, therefore, necessary for all those who are interested to practise collecting and transporting activities. In addition to the treatment and disposal of hazardous wastes, they must obtain an official license from the Ministry of Environmental Protection, in order to achieve the dimensions of the sustainable circulation of hazardous wastes, namely the environmental, economic, social and technological dimension, with specific focus on the environmental one that is now considered as a priority regarding the danger of this waste on the environment and human health.
