| dc.description.abstract | إنّ عمليّة إثبات الركن المعنوي في الجرائم تقتضي لزوما على السُّلطة القضائية البحث في مدى توافر الإرادة الآثمة التي تربط بين ماديات الجريمة ونفسية فاعلها، بحسب توصيف نص التجريم للنموذج الإجرامي الذي يشمل بيان الدلائل المادية والمعنوية للواقعة الإجرامية. غير أنّ جرائم القانون الجنائي الاقتصادي وما تمتاز به من خصوصية تجعل من مهمة القاضي الجنائي تنتقل من عملية الإثبات القائم على أساس المسلمات الحقيقة الثابتة إلى حتمية الإثبات على أساس افتراض الركن المعنوي، أي من خلال تحليل الجانب النفسي والشخصي المرتبط بالجاني، من خلال محاولة استنتاج واستنباط القرائن لإقامة الدليل المعنوي، حسب ما تتطلبه مقتضيات حماية النظام الاقتصادي العام للدولة.
