حدود سلطات الضبط الإداري لحماية الحقوق والحريات الفردية

Abstract

ملخص: تمارس سلطات الضبط الإداري مهامها المخولة إليها في إطار الاضطلاع بحماية النظام العام بمختلف مقوماته، حيث تخضع إجراءات الضبط الإداري في الأوضاع العادية لقيود أو ضوابط تتعلق بمقتضيات المشروعية بصفة عامة، والرقابة القضائية على إجراءات وتدابير الضبط الإداري بصفة خاصة، كما يمكن أن تحدث بعض الحالات الاستثنائية التي تبرر توسيع الاختصاصات المخولة لسلطة الضبط الإداري وفقا لهذه الظروف شريطة أن تلتزم هذه الهيئات بمراعاة مشروعية من نوع خاص أو كما يطلق عليها بالمشروعية الاستثنائية من خلال تطبيق عناصر المشروعية في ظل الأحوال الغير عادية. Abstract: The administrative control authorities exercise their functions within the framework of carrying out the protection of public order with all its components. Administrative procedures in normal situations are subject to restrictions or controls relating to the requirements of legality in general and judicial control of administrative control procedures and measures in particular. These procedure and measures justify the extension of powers vested in the administrative control authority in accordance with these conditions, provided that such bodies are obliged to take into account the legality of a particular type or the so-called extraordinary legitimacy through the application of the elements of legality under unusual circumstances.
