Abstract

This study is intituled "The argumentativity of Prophe's (p.b.u.h) Compagnons speach in Imam Malik's rit" in his "Mouat'a". It trays to answer the question of: considering Prophet's Compagnons speach, fatwas among jurisprudence bases in Malik's rit?" It procceded by four chapteres: First, Compagnons notion; second, the argumentativity of his speach; third, some steps of Malik life and his Mouat'aa. Finally, it mentions some of jurisprudence questions based on the Compagnons speaches. This study cam out to say that Imam Malik consider and use Compagnons speach in his jurisprudence rit . Exemples have also been given. Finally, it concludes that these sources should be used to resolve some contemporary questions that we don't find arguments in Quran , Sunna or Ijma'a´.
