عقد التّأمين الإلكتروني بين الإرادة والإذعان في التشريع الجزائري

Abstract

تأثّرت الخدمة التّأمينية بما أفرزه التطوّر التكنولوجي، وأصبح عقد التّأمين يبرم في بيئة افتراضية بوسائل إلكترونية، ورغم عدم وجود نصوص قانونية منظمة لأحكامه، إلاّ أنّه تجسيدا لمبدأ سلطان الإرادة قد يكون عقدا رضائيا بالنّظر لما تتميّز به العقود الإلكترونية، عندما يبرم باستخدام برامج المحادثة أو الوسائل السمعية المرئية التي تسمح للأطراف التّفاوض حول شروط العقد إلى جانب العروض التي تتيحها شبكة الانترنت، ومع ذلك قد يكون نموذجا لعقد الإذعان فالمؤمّن له وبعد ضغطه على عدد الخانات المقترحة يجد عقود نموذجية معدة بشروط لا يملك أمامها سوى التّوقيع، ممّا يؤدّي إلى الإخلال بالتّوازن التّعاقدي. The insurance service has been affected by technological development. As a result, the insurance contract is now concluded in a virtual electronic context. Furthermore, although there are no legal texts regulating its provisions, and embodying the principle of will, it could be a consensual contract taking into account the characteristics of electronic contracts when they are concluded using chat programs or audio-visual means which allow the partners to negotiate the terms of the contract as well as the offers proposed by Internet. However, it could be a model compliance contract. The insured will find, after clicking on the multiple boxes offered, model contracts prepared with conditions where he will only have to sign. This leads to a breach of contractual balance.
