تعليل الاحكام عند ابن دقيق العيد (702هـ) من خلال شرحه لعمدة الاحكام

Abstract

"يتناول هذا البحث تعليل الأحكام عند ابن دقيق العيد من خلال شرحه لعمدة الأحكام، حيث أثرنا الإشكال الرئيسي الآتي: ما المنهج الذي سلكه العلامة ابن دقيق العيد في تعليل الأحكام من خلال شرحه لعمدة الأحكام؟ والهدف البارز لهذا البحث هو استكشاف مدى المزاوجة بين النظر الأصولي والتطبيق الفقهي في فكر العلامة ابن دقيق العيد من خلال كتابه إحكام الأحكام شرح عمدة الأحكام، وسلكنا في جواب الإشكال منهجا وصفيا للمفاهيم، تحليليا للمسائل والتطبيقات الفقهية والأصولية، مقارنا بين مذهب ابن دقيق العيد وغيره من أعلام الفقه والأصول، وأهم ما توصلنا إليه من خلال هذا البحث هو الرسوخ الفقهي والأصولي لابن دقيق العيد واستقلاله في كثير من الآراء عن المذهب بالترجيح، واستكشاف كذلك اختيار ابن دقيق العيد لمنهج النظر والتعليل في الأحكام المستنبطة في النصوص حيث بث ذلك في ثنايا كتابه الإحكام. ""This research deals with the explanation of the rulings of Ibn Daqiq alEid through his explanation of the book ""Umdat al-Ahkam"". Where we raised the main forms: What the approach taken by the scholar Ibn Daqiq El-Eid in explaining the rulings through his explanation of Umdat alAhkam? The prominent objective of this research is to explore the extent of pairing between fundamentalist consideration and jurisprudential application in the thought of the scholar Ibn Daqiq al-Eid through his book Ihkam al-Ahkam Sharh Umdat al-Ahkam. In answering the problem, we took a descriptive approach to the concepts, analytically to the issues and Fiqh and Usul applications, comparing the doctrine of Ibn Daqiq al-Eid and other scholars of Fiqh and Usul. The most important thing that we reached through this research is the Fiqh and Usul foundation of Ibn Daqiq al-Eid and his independence in many opinions from the doctrine with weighting. In addition, exploring the choice of Ibn Daqiq al-Eid for the method of consideration and reasoning in the rulings deduced in the texts, where this broadcast in the folds of his book Al-Ihkam."
