قاعدة درء الحدود بالشبهات و دورها في تحقيق الامن القضاني

Abstract

" إن موضوع البحث والمعنون بــــــــ: "" قاعدة درء الحدود بالشبهات ودورها في تحقيق الأمن القضائي"" موضوع ذو أهيمة كبيرة، ذلك لأنه جمع بين الشريعة الإسلامية والقانون لتبيين مدى فاعلية وأثر قاعدة درء الحدود بالشبهات في تحقيق الأمن القضائي. هذا؛ وقد تطرقنا في موضوع هذه الرسالة إلى ثلاثة مباحث؛ فخصصنا في المبحث الأول تعريفاً عاماً موسعاً لقاعدة درء الحدود بالشبهات، وحمكها، والحكمة من مشروعيتها، وأدلتها وقواعد ذات صلة بها، وجعلنا في المبحث الثاني مفهوم الأمن القضائي ومرتكزاته، وسبل تحقيقه، ومقوماته، ومعوقاته، وختمنا في المبحث الثالث والأخير بأهمية كل من الأمن والقضاء في الإسلام، وأثر درأ كل حد من الحدود على الفرد وعلى المجتمع. ولعلى من أهم النقاط التي استُنتجت من خلال البحث هي العلاقة القائمة والمرتبطة بين الأمن القضائي وقاعدة درء الحدود بالشبهات، فكل من الأمن القضائي وقاعدة درء الحدود هدفهما تحقيق الأمن والعدالة الاجتماعية بين عموم الناس""The topic of the research, entitled: “The Rule of Preventing Borders by Suspicions and Its Role in Achieving Judicial Security,” addresses the following problem: The extent of the effectiveness and impact of the rule of preventing borders with suspicion in achieving judicial security. This; In this thesis, we discussed three topics; In the first section, we devoted a general and expanded definition of the rule of warding off the border with suspicion, its rule, the wisdom of its legitimacy, its evidence and related rules.
