المسائل الفقهية التي بناها المالكية على قاعدة الاستصحاب كتاب الذخيرة القرافي ـ الطهارة والصلاة أنموذجا ـ

Abstract

"الاستصحاب من الأصول المعتمدة في المذهب المالكي لاستنباط الأحكام الشرعية. فحاولت أن أسلط الضوء على تطبيقاته في المذهب المالكي، فأدرجته ضمن عنوان محدود كالآتي: "" المسائل الفقهية التي بناها المالكية على قاعدة الاستصحاب من خلال كتاب الذخيرة للإمام القرافي ــ باب الطهارة والصلاة أنموذجا ــ"". لتوضيح مدى استعمال المذهب المالكي لهذا الدليل في المسائل الفقهية وحجيتهم فيهم. من خلال ثلاثة مباحث: أولاً تعريف بالمذهب المالكي ومفهوم دليل الاستصحاب. وثانياً ترجمة الإمام القرافي. ثم ثالثاً مدى تكيف المسائل الفقهية مع الاستصحاب. وتوصلت إلى أن الاستصحاب دليل معتبر في المسائل الفقهية لدى المالكية، من خلال المسائل التي أدرجوه فيها. ويعد دليل مستقلاً بذاته لبناء أحكام المذهب عليه. الكلمات المفتاحية: أصول المالكية، الاستصحاب، الأدلة المختلف فيها، القرافي، الذخيرة. "Istihaab is one of the principles adopted in the Maliki school of law to derive legal rulings. I tried to shed light on the evidence of companionship. And a point was included within a limited title as follows: “The jurisprudential issues that the Malikis built on the rule of companionship through the book Al-Thakhira of Imam Al-Qarafi-Chapter of Purity and Prayer Anmodja-.” To clarify the extent to which the Maliki school of thought used this evidence in jurisprudential issues and their authority on them. Through three investigations: First, a definition of the Maliki comet and the concept of a companion guide. Secondly, the translation of Imam Al-Qarafi. Then, thirdly, the extent to which jurisprudential issues are adapted to companionship. And I concluded that companionship is a significant evidence in the jurisprudential issues of the Malikis, through the issues in which they included it. It is an independent guide on its own to build the rulings of the doctrine upon.
