حق العودة في القضية الفلسطينية وفقا لقواعد القانون الدولي العام

Abstract

الملخص يعتبر حق العودة من الحقوق اللصيقة بشخصية الإنسان، وهو يرتبط ارتباطا وثيقا بمسألة حرية التنقل ومغادرة الشخص لبلده إلى أي مكان آخر، وبمسألة تجريم التهجير القسري، الذي يجد أساسه القانوني في قواعد القانون الدولي الإنساني والقانون الدولي لحقوق الإنسان والقانون الدولي الجنائي والقانون الدولي للاجئين. كما يرتبط بمجموعة القرارات الدولية التي تعترف بهذا الحق وتؤكد على حمايته. لذا، نتطرق في هذه الورقة البحثية إلى حق العودة في القضية الفلسطينية وفقا لقواعد القانون الدولي العام حيث نبين الأساس القانوني لحق العودة للاجئين الفلسطينيين وحق اللاجئين الفلسطينيين في التعويض. الكلمات المفتاحية: حق العودة – اللاجئ – الفلسطنيون. Abstract: The right of return is linked to the issue of freedom of movement, it is also linked to the question of the criminalization of forced displacement, which finds its legal basis in the rules of international humanitarian law, international human rights law, international criminal law and international refugee law. It is also linked to a series of international resolutions that recognize this right and emphasizes the protection. So, in this research paper we address the right of return of the Palestinian issue in accordance with the rules of public international law, where we show the legal basis of the right of return for Palestinian refugees and the right of Palestinian refugees to compensation.
