التعذيب بين الممارسة الفرنسية في الجزائر وحظر القانون الدولي

Abstract

إن سياسة القمع الرهيبة التي اتبعتها فرنسا اثناء احتلالها للجزائر، كان لها الأثر الكبير على الشعب الجزائري، فقد أهدر الفرنسيون كل حقوق الإنسان وحرياته، وسجلوا من الجرائم ما يندى لها جبين الإنسانية. فوحشية الاستعمار ستبقى راسخة ومنقوشة في ذاكرة الأجيال، وستبقى أحداثها بكثرتها وقسوتها وفظاعتها رمزا لهمجيته. فعمليات التعذيب المنظم والممنهج التي مورست ضد افراد الشعب جاءت مخالفة لكل المواثيق الدولية سواء في القانون الدولي لحقوق الانسان، والقانون الدولي الإنساني، او حتى القانون الدولي الجنائي. الامر الذي يستدعي منا البحث في هذه المواثيق عن التكييف القانوني لهذه الأفعال، وعن مدى إقامة المسؤولية الجنائية الفردية لكل من شارك في هذه العمليات من قريب او بعيد. France's terrible policy of repression during its occupation of Algeria has had a big impact on the Algerian people. The French have squandered all human rights and freedoms and have committed crimes against humanity. The brutality of colonialism will remain firmly entrenched in the memory of generations, and its events, cruelty, and horror, will remain a symbol of it's barbarian ideology. The systematic torture practiced against the people violated all international conventions, whether in international human rights law, international humanitarian law, or even international criminal law. Which requires us to examine these charters on the legal adaptation of these acts, and the extent of the establishment of individual criminal responsibility for those who participated in these operations from near or far.
