مقاصد العقوبة في الشریعة الإسلامیة والقانون الوضعي الحدیث -الجنایات نموذجا

Abstract

یدرس هذا الموضوع مقاصد العقوبة في النظام العقابي الاسلامي والقانون الوضعي من خلال التعرف على مقاصد العقوبة في كل منهما، وتحدیدا العقوبات الجنائیة التي تواجه اخطر الجرائم، فالعقوبة في الشریعة الإسلامیة توافق العقوبة في القانون الوضعي الحدیث فقد نصت الشریعة الإسلامیة عقوبة القصاص والحدود من أجل تحقیق مقاصد معینة لحمایة مصلحة الجماعة ولإصلاح الأفراد ومحاربة الجریمة ومنع وقوعها أو الحد من ارتكابها فالشریعة الإسلامیة لم تهمل الجاني بل تعمل على إصلاحه والرحمة به، وقد تنزهت عن العیوب الكثیرة التي لازمت القوانین الوضعیة، وقررت من القواعد والمبادئ ما یكفل سلامة المجتمع ویضمن تطبیق العقوبات ویراعي حقوق الإنسان وكرامته حتى لو كان مجرما لاشتمالها على أرقى المبادئ والخصائص التي تتصف بها العقوبة في حین مازال القانون الوضعي الحدیث حتى الآن یسیر خلف الشریعة الإسلامیة ولم یصل الى كمالها.. This subject studying purpose of punishment in the penal Islamic system and positive law through balancing the purposes of punishment in each one of them. and specifically criminal penalties facing the most serious crimes. the theory of punishment in Islamic law includes all the theories that have appeared at the beginning of the eighteenth .initiating retributive punishment and limits in order to achieve certain purposes to protect the interests of the group and the reform of individuals. and the fight against crime and prevent or reduce its commission. the Islamic law has not neglected the effender but working to fix him and clemency and has resulting for the many defects that have accompanied the man-made laws. and in response to the criticism of the law that it's sunctions are brutality and harsh. while decide from rules and principles that ensure the safety of the community and ensure the application of sunctions and take into account the human rights and dignity even if he was a criminal because it's include the finest principles and characteristics that characterize punishment. while the new positive law even know walking behind Islamic law and didn't reach to completeness.
