الاختيارات الفقهية لابن رشد الحفيد المالكي )ت 595 ه( في أحكام الإجارات من خلال كتابه بداية المجتهد ونهاية المقتصد

Abstract

تناول ىذا البحث جانبا مهما من فقو المعاملات؛ وىو ما يتعلق بأحكام الإجارات، وقد تركز البح ث على ما اختاره أحد أئمة الفقو، وىو الإمام ابن رشد الحفيد من خلال كتابو الماتع بداية المجتهد ونهاية المقتصد. حاول الباحث من خلال الدراسة الوقوف على اختياراتو في باب الإجارات ودراستها وتحليلها ثم مقابلتها بأقوال العلماء، والوصول لإجابة على عدة إشكالات أبرزىا: ما الذي يميز اختيارات الإمام ابن رشد الحفيد؟ وما ىو المنهج الذي اعتمده في اختيار تلك الأقوال على تلك؟ وت و ج البحث في ختامو ببعض النتائج والتوصيات المتوصل إليها لعل أهمها: أن الذي ميز اختيارات الإمام ابن رشد الحفيد أنها كاون من جملة التوصيات لطلبة العلم والباحثين ىو مواصلة وإكمال دراسة اختيارات الإمام ابن رشد الحفيد في الأبواب الأخرى من كتاب بداية المجتهد. Abstract - This research dealt with emportante part of jurisprudence of transactions related to the rules of wages , The research focus on the choice of one of the senior jurists, He is the imam IBN Rushden orandson through his book "bedayat almujtahid wa nihayath Almukhtasid ". The researcher tried to stand up for his choices in the chapter of rents study and analyse them, meet then with the words of scientists (oulamas), The researcher wanted this study to reach the answers to several problems, The most prominent issues are what distinguish s imam's IBN Rushd choice? and what is the approach adopted by the test? At the end of the research some of the most important conclusions and recommendations: Imam 's choices based- on evidence he saw and the face of inference and he did not abide by his doctrine . The most important results reject the malikiya's connection with stalemate and intolerance And recommending to students and researchers to continue and complete the examination of the tests of imam IBN Rushd.
