Abstract

"دراسة موضوع ""آليات حماية الاسرة زمن النزاعات المسلحة دراسة مقارنة بين الفقه الاسلامي والقانون الدولي الاسلامي""، إلى التعرف على الآليات التي جاء بها الفقه الاسلامي والقانون الدولي الانساني لحماية الأسرة زمن النزاعات المسلحة وتوضيح أوجه التشابه والاختلاف بينهما. وتتضمن الدراسة محاولة الإجابة عن الاشكالية المتمثلة في ""فيما تتمثل آليات حماية الأسرة زمن النزاعات المسلحة، بين الفقه الاسلامي والقانون الدولي الانساني؟""، حيث تمثلت أهمية هذا البحث في التطرق لقضية النزاعات المسلحة التي أصبحت من الظواهر التي تعيق دور الأسرة والمجتمع والتي تشهدها عديد دول العالم دون مراعاة الجوانب الانسانية. في حين تمثل الهدف العام للبحث في التعرف على الأسرة كونها اللبنة الأولى في تشكل المجتمعات، كما تهدف لتسليط الضوء على النزاعات المسلحة وما تخلفه من آثار على المجتمع عامة وعلى الأسرة خاصة. وقد توصلت الدراسة إلى نتائج أهمها أن قواعد القانون الدولي الإنساني فيما يتعلق بمعاملة المدنيين غنية بمختلف أنواع الضمانات التي تكفل الحماية اللازمة لهم، وهي في ذلك تتفق من حيث المبدأ مع تلك المقررة في أحكام الشريعة الإسلامية؛ وإن أحكام الشريعة الإسلامية بما حوته من أهداف عامة ومقاصد كلية لتكريم الإنسان وتقديره، قد وضعت إطارا واسعا يمكن التأسيس والتفريع عليه لتقرير أوجه الحماية الفعالة للفئات المختلفة من المدنيين التي تظهر بتطور الحياة، كما هو الشأن بالنسبة لعمال الإغاثة وأفراد الخدمات الطبية، وتوصلت الدراسة أيضا الى أن الواقع العملي يكشف أن أشكال الحماية المقررة للمدنيين في ظل القانون الدولي الإنساني لا تعدو أن تكون ضمانات نظرية تخرق بشكل واسع ومستمر في النزاعات المسلحة المعاصرة. While the general objective of the research is to identify the family as the first building block in the formation of societies, it also aims to shed light on armed conflicts and their effects on society in general and on the family in particular. The study reached the most important results, the most important of which is that the rules of international humanitarian law with regard to the treatment of civilians are rich in various types of guarantees that guarantee the necessary protection for them, and in this they are in principle consistent with those established in the provisions of Islamic Sharia; The provisions of Islamic Sharia, with its general objectives and holistic purposes for honoring and appreciating the human being, have set a broad framework that can be established and branched over to determine effective protection aspects for the different categories of civilians that appear with the development of life, as is the case for relief workers and medical personnel, and the study also found The practical reality reveals that the forms of protection provided for civilians under international humanitarian law are no more than theoretical guarantees that are widely and continuously violated in contemporary armed conflicts
