Abstract

Abstract: This study aims to shed light on the effectiveness of the committee for opening envelopes and evaluating bids within the current system for managing public transactions in Algeria, specifically Law No. 23-12 of August 5, 2023, which outlines the general rules for public transactions, and Presidential Decree No. 15-247 dated Dhul-Hijjah 2, 1436 corresponding to September 16, 2015, which regulates public transactions and authorizations for public facilities. The committee plays a significant role in the management of public transactions through internal control mechanisms. However, legislative and organizational texts fall short of meeting the aspirations of this committee to effectively achieve its objectives in the practical execution of its duties. This disparity between theoretical frameworks and professional realities necessitates further research and study to bridge the gap between them.
