الإجتهاد النوازلي للشيخ أحمد حماني من خلال فتاويه المطبوعة - الأحوال الشخصية أنموذجا

Abstract

"ملخص البحث تناول هذا الموضوع الاجتهاد النَّوازلي للعلامة الشَّيخ أحمَّد حمَّاني في باب الأحوال الشخصية من فتاويه المطبوعة، حيث تطرقتُ في المبحث الأول إلى حياة الشَّيخ من حيث المولد والنشأة مرورا بمسيرته التعليمية إضافة إلى شَّيوخه وتلاميذه الذين أخذوا عنه علمه، ثم مسؤولياته والمناصب التي تقلدها في حياته ومنهجه في فتواه، وأهم ما ميز شخصيته، ثم آثاره الموروثة لنا ووفاته، بالإضافة إلى دراسة بسيطة حول كتابه الفتاوى. أما المبحث الثاني فقد تعرضت من خلاله إلى مفهوم الاجتهاد النَّوازلي، وبيان حكمه وضوابطه التي يجب أن تراعى، ثم فوائد النظر في النوازل وآداب المجتهد النَّوازلي. وجاء المبحث الثالث ليبين كيف استطاع الشَّيخ حمَّاني وضع الحكم المناسب لكل مسألة مستجدة في مختلف أبواب فقه الأسرة مراعيًا فيها ما يجب على الفقيه النَّوازلي مراعاته.

" "Abstact: This topic dealt with the judgment of stalactite from the scholar ""Sheikh Ahmed Hamani"". In a personal status of his printed opinions (fatwas). In the first chapter, we presented the live and birth of the sheikh through his educational background. In addition to his elders and disciples who took knowledge from him. Then his responsibilities and job position in his life and method of fatwas. Also important features of his personality, in addition to a simple study of his book of fatwas. Whereas in the second chapter, I presented the definition of""judgment of stalactite"", showing rules and regulations that must be respected. also the goal of regarding stalactite and the literature of the hardworking of stalactite. The third chapter came to show how sheikh Ahmed Hamani could give the appropriate judgment for each emerging issue in various stages of the jurisprudence of the family taking into account what the muslim jurist must observe."
