Abstract

"يدرس هذا البحث موضوع عقود الصيانة، عن طريق تتبع مسائلها؛ من حُكم وحكمة وشروط وأنواع وخصائص، محاولين الكشف عن أهم الأحكام الشرعية التي تتعلق بهذا العقد المستحدث، والتي لم يتطرق لها الفقهاء القدامى ولم تكن معروفة عندهم، فجاء هذا البحث من أجل ضبط أحكام ومسائل هذا العقد من خلال ما سطره الفقهاء من أحكام وقعدوه من قواعد تضبط المعاملات المالية بضوابط الشرع الحنيف. فكان هذا البحث بيانا لأهميَّة العلم بهذه الأحكام الشرعية وتفعيلها في الواقع العمَلي، لما فيها من تحقيق منافع عظيمة للفرد المسلم والمجتمع، في كل الميادين، وبيان ما في الجهل بها من مخاطر، أو التهاون في تجسيدها عمليًا من مفاسد تضر بالفرد والمجتمع بأسره. This research studies the subject of maintenance contracts، by tracing the provisions of maintenance contracts; From the rule، wisdom، conditions، types and characteristics، trying to reveal the most important legal provisions related to this newly created contract، which the old jurists did not address and were not known to them، and which we will explain through books of interpretation، explanations of hadith and approved jurisprudence and jurisprudence rules; That regulates jurisprudential financial transactions. This is in order to clarify the importance of knowledge of these provisions and their activation in practical reality، and the realization of great benefits for the Muslim individual and society، and in all fields، and to clarify the dangers in ignorance of them، or negligence in their practical embodiment of evils that harm the individual and society as a whole.
