التأجير من الباطن -تأجير الأسواق الأسبوعية نموذجا-

Abstract

"تناولت هذه المذكرة موضوع التأجير من الباطن وأحكامه في الفقه الإسلامي انطلاقا من الإشكال الآتي: ما هو التأجير من الباطن؟ وهل يعتبر إعادة تأجير الأسواق الأسبوعية من المكس كما يطلق عرفا أم من الإجارة من الباطن؟ والذي ينقسم إلى مبحثين: الأول كان مبحثا نظريا لبيان ماهية التأجير من الباطن والثاني كان مبحثا تطبيقيا تضمن مسألة تصوير إعادة تأجير الأسواق الأسبوعية وفق عقد مختار بصفته نموذجا للدراسة، وفي الأخير توصلت الدراسة إلى نتائج أهمها؛ أن التأجير من الباطن كمعاملة مالية تختصر الجهد والوقت على المتعاملين بها كما أن فيها مصلحة خاصة تخدم المصلحة العامة وتيسرها.""This memorandum dealt with the subject of sub-leasing and its Islamic jurisprudence rulings, starting from the following problem: What is sub-leasing?, Is the re-leasing of the weekly markets considered a mix as it is customarily called, or a sub-leasing?. and other sub-problems. Which is divided into two sections: The first was a theoretical study to clarify the nature of sub-leasing, and the second was an applied study that included the issue of depicting the weekly re-lease of the market according to a selected contract as a contemporary financial transaction. Finally, the study reached the most important results Sub-leasing as a financial transaction shortens the effort and time for its dealers, as it has a special interest that serves and facilitates the public interest."
