حماية اليتيم في الشريعة والقانون الجزائري - دراسة مقارنة -

Abstract

"لبعث روح الاهتمام باليتيم والإحسان إليه ومشاركته آلامه وأقراحه, تأتي هذه الدراسة لتعالج موضوعا متعلقا بحماية اليتيم من الناحية الشرعية والقانونية. وقد تكونت هذه الدراسة على مقدمة وثلاث فصول: الفصل الأول: تناولت فيه مختلف التعريفات اللغوية والاصطلاحية والشرعية والقانونية لليتيم وأنواع اليتيم وآجال انتهاء اليتم ومنزلة اليتيم في الإسلام وفضل العناية به وكفالته. والفصل الثاني: تطرقت إلى الحقوق الغير مالية التي يجب أن يحظى بها اليتيم كالرضاعة والحضانة والنسب والرعاية وكذلك الولاية وأنواعها وشروطها والكفالة والشروط التي يجب أن تتوفر في الكافل وضمان حماية هذه الحقوق من الناحية الشرعية والقانونية. الفصل الثالث:ذكرت فيه الحقوق المالية التي يجب حمايتها والمحافظة عليها والضوابط القانونية والشرعية التي تحمي هذه الحقوق و ذكرت بعض التصرفات التي ترد على مال اليتيم كتنمية مال اليتيم والزكاة على مال اليتيم.
