العقوبة المالية وعلاقتها بالمقاصد الضرورية

Abstract

إنّ أهم ما يسعى إليه هذا البحث هو بيان العلاقة بين العقوبة المالية والمقاصد الضرورية باعتبارها جزءا من المنظومة التشريعية للعقاب التي تقوم على مبدأ صيانة الضروريات الخمس والمحافظة عليها، فما صور العقوبات المالية لحفظ الضروريات الخمس؟، وما مدى تناسبها مع مقدار الأذى والضرر الواقع على نوع المقصد المنتهك ومرتبته في السلم المقاصدي؟ هذا ما تم معالجته وفق قواعد المنهج العلمي المطلوبة في مبحثين: خص الأول منهما لتحديد المفاهيم الأساسية وتعريف مصطلحات البحث، وخص الثاني للنماذج التطبيقية وصورها لبيان العلاقة المرجوة من البحث مع خاتمة تؤكد منطلق العلاقة بين العقوبات الشرعية كوسائل لحفظ الضروريات الخمس . The most important thing that this research seeks is to show the relationship between financial punishment and the necessary purposes as part of the legislative system of punishment, which is based on the principle of maintaining and maintaining the five necessities. What are the forms of financial penalties for preserving the five necessities, and to what extent are they proportional to the amount of harm and damage caused to the type of destination violated and its rank in the intentional ladder? This is what has been addressed according to the rules of the scientific method required in two sections: the first of them to identify the basic concepts and the definition of research terms, and the second was devoted to applied models and their images to show the desired relationship of the research with a conclusion that confirms the starting point of the relationship between Sharia penalties as means to save the five necessities.
