النظام القانوني لتوزيع المنتجات الصيدلانية في التشريع الجزائري -الأدوية الجنيسة نموذجا-

Abstract

لمشرع الجزائري المنتجات الصيدلانية بموجب قانونالصحةأين تم ذكرها على سبيل الحصر بهدف فرض سياسة الاحتكارفي حيازتها وتوزيعها على فئة معينة من المهنيين دون غيرهم وهذا نتيجة للدور الذي تلعبه هذه المواد في الترقية وحماية الصحة العمومية، وعملية توزيع المنتجات الصيدلانية وبالخص الدوية الجنيسة تعتبر من المسائل الحساسة والخطيرة في نفس الوقت لذلك نظمها المشرع وقسمهاإلى توزيع بالجملة تشرف عليه مؤسسات صيدلانية مختصة ومرخص لها قانونا بذلك والتوزيع بالتجزئة التي جعلها المشرعمن اختصاص الصيدلي دون غيره،وحتى تتمعملية التوزيع لابد من شروط يجبأن تتوافر في الموزع سواءأكان شخص طبيعياأممعنوياإذا تعلق المر بالتوزيع بالجملة وشروط خاصة بالموزعإذا تعلق المر بالتوزيع بالتجزئة بالضافةإلى توافرأجهزة و محلات مخصصة لذلك ووسائل نقل لضمان سلامة هذه المادة ووصولهاإلى المريض محفوظة بطريقة تؤدي من خلالها دورها العلاجي التي صنعت منأجله. The Algerian legislator organized and promoted pharmaceutical products under the Health Protection Act, where they were mentioned exclusively for the purpose of enforcing a monopoly policy in possession and distribution to a certain group of professionals. This is due to the role played by these materials in promoting and protecting public health. The distribution of pharmaceutical products, especially generic drugs, is considered a sensitive and serious issue. Therefore, it was organized by the legislator and divided into a wholesale 23911012382532020 distribution supervised by specialized pharmaceutical institutions, licensed by law and retail distribution which the legislator entrusted exclusively to the distribution of the pharmacist. Distribution is subject to a number of conditions that must be available in the distributor whether it is a natural or a legal person in relation to wholesale distribution. The distributor is also subject to conditions in relation to retail distribution. This is in addition to the availability of equipment and shops dedicated for this purpose and means of transportation to ensure the safety of this material and its arrival to the patient while reserved in a manner appropriate for the therapeutic role it was manufactured for.
