حماية أماكن العبادة أثناء النزاعات المسلحة بين الشريعة والقانون الدولي-المسجد الأقصى انموذجاً-

Abstract

" موضوع بحثي حول ( حماية أماكن العبادة أثناء النزاعات المسلحة بين الشريعة والقانون الدولي،- المسجد الأقصى أنموذجاً-). هو بحث اعتمد على المنهج الوصفي، والتحليلي، والتاريخي، والمقارن، وهو مقسم إلى ثلاثة مباحث، بالإضافة إلى النتائج والمقترحات، اعتنى المبحث الأول بوضع هذا الموضوع في إطاره المفاهيمي، والمبحــث الثاني تعرض إلى حماية هذه الأماكن بين الشريعة والقانون الدولي بصفة عامة, والمبحث الثالث عرَّج على وصف وضعية المسجد الأقصى كنموذج لهذه الأماكن المقدسة من ناحية انتهاكات الاحتلال الإسرائيلي، ومن ناحية حمايته بين الشريعة والقانون الدولي، ومن أهم النتائج التي خلص إليها البحث، وجود تناغم وانسجام لحد كبير بين الشريعة والقانون الدولي في وضع التدابير الوقائية اللازمة لحماية أماكن العبادة أثناء النزاعات المسلحة، ومن أهم المقترحات التي خلص إليها البحث، مطالبة كل وسائل الإعلام بإبراز خطورة التعدي على المسجد الأقصى للرأي العام، والعمل على ترسيخ مبدأ الدفاع عن القدس بالقول والفعل. "Abstract My research topic is protection of religious buildings during armed conflicts between the islamic legislation and international law , Al- aqsa Mosque a sample example. My studies are based on descriptive, analytic, historical and comparative approach . It is divided into three chapters besides the findings and suggestions. The first chapter concerns the interpretation of the topic. The second chapter generally dealt with the preservation of religious buildings in war times between the islamic legislation and international law. The third chapter took the israeli violations to Al- aqsa Mosque as a sample example and its protection between legislation and law. The findings show that there is much agreement and harmony between the islamic legislation and international law in taking the necessary measures to protect religious buildings during armed conflicts. My research made critical suggestions such as urging all media to spot the dangers of violating Al- aqsa Mosque and made them public as well as working on defending it by all means as a princip "
