تدخّل المشرّع لتطويع مبدأ حرية المنافسة لمصلحة المستهلك

Abstract

يُنظر للعلاقة التّي تجمع بين حريّة المنافسة ومنظومة حماية المستهلك بأنّهما متناقضتان، على اعتبار أنّ لهما توجّهين مختلفين، فالأوّل يشجّع الاتّجار والرّبح والثاني يحمي منهما طرفا ضعيفا هو المستهلك، كما أنّ القائمين عليهما شخصان يقفان على طرفي نقيض من ناحية القوّة الاقتصادية، غير أنّ روح التشريع التّي تستهدف تحقيق المصلحة العامة، تدرك كيف تحافظ على الحقوق المشروعة لجميع الأطراف، هل هذا الأمر ينطبق على مبدأ حرية المنافسة وحقوق المستهلك؟ هل فعلا طوّع المشرّع المبدأ ليخدم مصالح المستهلك؟ هذا ما يعالجه هذا المقال. Abstract: The relationship between the freedom of competition and the consumer protection system is viewed as contradictory, because they are of two different orientations, the first encourages trading and profit, the second protects a weaker part: the consumer, as well as, The two people who are in charge of them stand on different sides in terms of economic power, but the spirit of legislation that seeks to achieve the general interest, realize, in turn , how to preserve the legitimate rights of all parties. Is this vision applied to the principle of competition's freedom and of consumer rights? Has the legislator really tammed the principle to serve the interests of the consumer? This issue is addressed in this article.
