Abstract

"لقد تناولت في هذه المذكرة ثلاثة فصول، أولها تمهيدي، و الآخران اشتمل كلٌّ منهما على مبحثين، هي على التوالي، العرايا، الجوائح، الرهن، فالشركة، و قد أسلفت تلخيص كل فصل في آخره بما يغني عن إيراده في الملخص العام، لكن على وجه أوجز مما سبق فإني تناولت في التمهيدي تعريفا عاما شاملا لكل جوانب المؤلف من حيث بيئته، و حياته العلمية و العملية، و المصطلحات التي قام عليها البحث، و التي وَثُقَ صلتها بها، و ما يلزم في باب الاختيار الفقهي من ضوابط. ثم في المبحثين العمليين، تناولت في كل منهما تعريفات بمفاهيم المسائل التي تفرعت عنها، و صورها لدى الفقهاء، و اختيارات ابن رشد، مُتْبِعَا ذلك بتحرير لمحل النزاع مع ما صاحبه من تفصيل لأقوال المذاهب و أدلتهم و استدلالاتهم، مُنْهِيَا ذلك بما ترجح مما تبين من الأدلة المعروضة، و الاستدلالات التي وردت عليها. "" In this research, I dealt with three chapters, the first of which is introductory, and the other two, each of which included two topics, are, respectively, the nakedness, the catastrophes, the mortgage, and the company. Summarized from the foregoing, I dealt in the preliminary comprehensive definition of all aspects of the author in terms of his environment, his scientific and practical life, the terminology on which the research was based, and whose connection to it was documented, and the necessary controls in the chapter on jurisprudence. Then, in the two practical sections, I dealt in each of them with definitions of the concepts of the issues that branched out from them, and their forms among the jurists, and the choices of Ibn Rushd, followed by editing the subject of the dispute with the accompanying details of the sayings of the schools, their evidence and their deductions, ending that with what is more likely than what has been shown from The evidence presented, and the inferences drawn from it.
