حـــريـــــة الــــرأي والتعبيـــــر بيـــــن النظــــريــــة والتطبيــــق في القضاء الدستوري

Abstract

ملخــــص: تعتبر حرية الرأي والتعبير من أهم الحريات الأساسية لأنها أساس للممارسات الديمقراطية والتي من خلالها يستطيع الفرد التعبير عما يدور بداخله بمختلف الوسائل المتاحة، وتستمد وجودها من مختلف إعلانات حقوق الانسان مثل إعلان حقوق الانسان لفرنسا لسنة 1789 والإعلان العالمي لحقوق الإنسان لعام 1948. ونظرا للأهمية البالغة لحرية الرأي والتعبير جعلت لها مختلف دول العالم قواعد ذات طابع دستوري لحمايتها وتحديد نطاقها وأسندت هذه الحماية إلى جهات القضاء الدستوري الذي يسهر على صيانة وحماية حرية الرأي والتعبير من خلال مدى دستورية القواعد القانونية المنظمة لهذه الحرية انطلاقا من مبدأ سمو القاعدة الدستورية. Abstract: Freedom of opinion and expression is one the most important and freedoms as it is basic to exercising democracy through which the individual can express himself in all manners. This basic freedom has its roots in different human rights declarations such as the French one of 1789 and the world one of 1948. Regarding its importance, many states have provided it in its constitutions for protection and scopes; and made the constitutional judiciary the protecting organ which stay up for the control of the constitutionality of all rules related to this fundamental right based on the fact that the constitutional rules are the highest rules that must not be breached at all.
