Abstract

In our research we have dealt with this crime in general and its historical development in Islamic jurisprudence and international law. It is prohibited by legitimacy. The crime in Islamic jurisprudence are in types: crimes border, and retribution. crimes in international law are external action which is done by humans violating law which provides for the punishment and that is not justified by the performance of duty or of the right. These crimes are in types: felony, misdemeanor, offense and this according to the gravity of the crime and its corners: corner of the physical, the mental element, legitimate corner, and its historical development over the ages in many different system of criminalization of the primitive age and the Roman era to the era of the Pharaonic unlike the historical development of Islamic jurisprudence, which began to kill Cain for his brother Abel In the first chapter I’ve dealt with what Illicit Traffic in Narcotic Drugs and Psychotropic Substances in Islamic jurisprudence including the nature of drugs and psychotropic substances in Islamic jurisprudence and international law. The psychotropic substances are either natural or artificial substance listed in Table 1, 2, 3 and 4 of the Convention on Psychotropic 1971 kinds of mental precursors, lotion, hemp, drugs made from chemicals and other such as Heroines and it’s like. As for sanctions in Islamic law they are all deprived by God to deter the commission of what is banned and ignoring what was ordered.
