آليات حماية الأطفال بين الفقه الإسلامية والقانون الجزائري

Abstract

"الملخص يعالج موضوع الدراسة أحد المواضيع المهمة في التشريع الجنائي الإسلامي وكذا القانون الجنائي الجزائري الموضوعي باعتباره يتناول البحث في آليات الحماية التي أقرتها الشريعة الإسلامية وكذا التشريع الجنائي الجزائري من أجل حماية حقوق الطفل ورعايته ليصبح عضوا فعالا في المجتمع وهذا انطلاقا من الإشكال الآتي ما هي الآليات: ما هي الآليات التي أقرتها الشريعة الإسلامية والقانون الجنائي الموضوعي لحماية حقوق الطفل؟ وقد اتبعنا لدراسة هذا الموضوع كلا من المنهج الاستقرائي والوصفي والتحليلي والمقارن لتوضيح آليات حماية حقوق الطفل ،وفي النهاية هذا البحث توصلنا إلى عدة نتائج أهمها: جرم كل من الشريعة الإسلامية والمشرع الجزائري جميع الاعتداءات التي يتعرض لها الطفل, كما اتخذا مجموعة من الإجراءات قصد حمايته من الخطر الذي قد يهدده. وقد تم طرح بعض التوصيات منها: تعزيز إعادة تأهيل الأطفال وإدماجهم في المجتمع ."Abstract This research explores a significant issue in the Islamic criminal legislation and the Algerian criminal law. Focusing on the preventive mechanisms approved by both criminal legislations to protect and care for the rights of the child, it asks: What are the mechanisms approved by the Islamic jurisprudence and the state criminal law for protecting the rights of the child? We have employed an analytical, descriptive and comparative approach to identify the mechanisms put to protect the rights of the child. The results indicate that all violations against childrenwere criminalized by the Islamic Jurisprudence and the Algerian legislation. Additionally, the latter took several preventive procedures to protect the child from the dangers that might threaten them. On this basis, the study provided some recommendations such as: reinforcing the rehabilitation of children and their inclusion in society.
