Abstract

"ملخص هذه الدّراسة الموسومة بــ: ""إعمال التهمة عند المالكية وتطبيقاتها من خلال كتاب بداية المجتهد ونهاية المقتصد لابن رشد الحفيد"" - دراسة تأصيلية تطبيقية لنماذج مختارة- حاولتِ الإجابة عن الإشكالية الأساسية الآتية: ما مدى إعمال المالكية للتهمة، وما تطبيقاتها من خلال كتاب بداية المجتهد ونهاية المقتصد لابن رشد الحفيد؟ جاءت الدراسة في مباحث ثلاثة؛ الأول مفاهيميّ، تناول مفهوم التهمة عند المالكية، والترجمة لابن رشد الحفيد، ولكتابه بداية المجتهد، أما الثاني فتأصيلي، تناول علاقة التهمة ببعض الألفاظ ذات الصلة، والأدلة على اعتبارها، وإلى شروط إعمالها ومراتبها، وبعض أنواعها في بابي المعاملات المالية والأقضية والشهادات، ثم تطرّق إلى مسالك الكشف عنها وإلى مسقطاتها، أما المبحث الثالثُ التطبيقي وقع الاختيار فيه على نماذج من الكتاب محل الدراسة. توصّلتِ الدراسةُ إلى جملة من النتائج أهمها: أن المالكية يُعملون التهمة سدّا لذريعة الوصول إلى الممنوع شرعا، وأن هذا الإعمالَ مبني على شروط وضوابط وجودها يقوّي التهمة والعمل بها، واختلالها يؤدي إلى إهمالها، ومن ثَمَّ يؤدي إلى فتح الذرائع. كما أوصت الدراسة بتوسيع البحث في موضوع التهمة عند المالكية بتعمق أكثر، من خلال دراسة نماذج أخرى ومن أبواب متنوعة. والحمد لله ربّ العالمين.""Abstract This study, entitled ""The Application of Al-Tohma in Maliki Jurisprudence and its Applications through the Book ""Bidayat Al-Mujtahid"" and ""Nihayat Al-Muqtasid"" by Ibn Rushd the grand son"" - An Applied Foundational Study of Selected Models - This study aims to address the fundamental question of the extent to which the Maliki school of jurisprudence applies the concept of Al-Tohma, and its practical implementations as found in the works of Ibn Rushd the grand son, The study consists of three sections: the first is conceptual, addressing the concept of Al-Tohma according to the Maliki school and its translation by Ibn Rushd the grand son in his book ""Bidayat Al-Mujtahid."" The second section is foundational, discussing the relationship between charges and related terms, the evidence supporting their consideration, the conditions for their application, their levels, and various types in financial transactions. It also covers the methods for uncovering charges and their nullification. The third section is practical, focusing on selected models from the studied book. The study has arrived at several conclusions, the most significant of which are as follows: The Maliki school employs Al-Tohma as a means to access what is prohibited by using a pretext. This practice is based on specific conditions and regulations that strengthen the charges and their application. Any imbalance in these conditions can lead to neglecting the charges, which, in turn, leads to the opening of legal justifications. Furthermore, the study recommends expanding further research on the topic of Al-Tohma within the Maliki school by delving into other models and exploring various aspects.
