Abstract

"لقد تطرقنا في دراستنا هذه إلى موضوع وسائل الإثبات في جرائم الحدود الاعتراف أنموذجا دراسة مقارنة بالقانون الوضعي، مجيبتين على الإشكال الاتي: ماهي وسائل الاثبات في جرائم الحدود ؟ وهل يعتبر الاعتراف وسيلة كافية لإثبات جرائم الحدود؟ حيث بينا فيه دور الاعتراف في إثبات جرائم الحدود. إذ يعد الاعتراف من بين وسائل الإثبات الجنائية التي يعتمد عليها القاضي في تحقيق العدالة. ولأهميته في إثبات جرائم الحدود فقد أحاطته الشريعة الإسلامية والقوانين الوضعية بمجموعة من الشروط حتى يكوم صحيحاً منتجاً الآثار، كما راعيا أحكامه عند الرجوع عنه أو تقادمه.

Confession is considered among the among the mean of confirmation that the judge depend on to adieve justice, and due to its importance in proving crines of prescribed penaliahties it has been surrounded by Islamic law and statuary law by a set of conditions so that it can be productive of its effects and taking in to consideration Fiqh and the law judgment in case of retaction and aging.
