الوقف واستثماره في الفقه الإسلامي (نماذج وقفية من ولاية ورقلة)

Abstract

"ملخص فهذه مذكرة بعنوان: استثمار الوقف الإسلامي في الفقه الإسلامي (نماذج وقفية من ولاية ورقلة) اشتملت المذكرة على مقدمة, وثلاثة فصول, وخاتمة, فأمّا الفصل الأول والثاني فقد خصص للدراسة النظرية, بحيث جاء الفصل الأول متناولا تعريف الوقف وأحكامه الفقهية, وجاء الفصل الثاني متضمنا الاستثمار وعلاقته بالوقف, وأحكامه الشرعية. وأمّا الفصل الثالث فكان دراسة حال لواقع الوقف في ولاية ورقلة, وعرض لبعض النماذج الوقفية الاستثمارية في هذه الولاية. وفي الخاتمة ذكرت فيها أهم النتائج التي انتهيت إليها, وبعض الاقتراحات التي من شأنها أن تخدم الموضوع. الكلمات المفتاحية: الوقف, الاستثمار, الأحكام الشرعية, الأموال الوقفية.

" The present work is a study entitled- -Investing the Islamic donating at Islamic the Jurisprudence (Waqf Models the wilaya of Ouargla - This work consists of three chapters. The first chapter was dedicated to the theoretical study- it is about the definition of the waqf and its jurisprudential laws. The second chapter expose the condition of the investment and its relationship with the waqf and its laws. The third chapter presents the case study of the reality of El Waqf in the wilaya of Ouargla, as well as a presentation of some investment models of el Waqf in the same wilaya.In conclusion, I mentioned the most important conclusions that I had extraced and some suggestions that could serve the subject.Keys words - Investing - Islamic donating - the waqf - jurisprudential laws
