قاعدة "المشقة تجلب التيسير" وتطبيقاتها في فقه ا أ لسرة النفقة أ أنموذجاً

Abstract

ىذا البحث يسلط الضوء على موضوع "القواعد الفقهية" التي ت٘ثل دعائم علم الفقو كعلاقتو تٔوضوع "النفقة" التي يتجدد احتياج الناس لذا، إلا أننا خصصنا الدراسة على قاعدة كلية كبرل كاحدة ىي قاعدة "الدشقة تٕلب التيستَ"، بعد مدخل عا حوؿ ماىية القواعد الفقهية، ثم تطرقنا إلى موضوع النفقة كأحكامها كطوينا البحث بأىم مظاىر الدشقة الواقعة على النفقة ألا كىي "الإعسار"، كأكجو التيستَ فيها التي رآىا الفقهاء. Abstract This research sheds light on the subject of jurisprudential rules that represent the pillars of jurisprudence, and its relationship to the subject of alimony, which is renewed by people's needs. However, we devoted the study to the basis of one major college, "hardship, bringing facilitation" after a general introduction on what is the jurisprudential rules. Then we discussed the issue of alimony and its provisions, and we discussed the most important manifestations of hardship on the expense, namely which, "insolvency", and the facilitation of it, our forefathers saw.
