جرائم التمييز وخطاب الكراهية في التشريع الجزائري

Abstract

تسعى هذه الدراسة إلى تسليط الضوء على القانون رقم 20/05 الصادر بتاريخ 28 نيسان/ أبريل 2020 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما. ولا شك أن تحليل هذه المسألة يرتبط إلى حدٍ كبير بالصكوك الدولية لحقوق الإنسان التي انضمت إليها الجزائر، لذلك إرتأينا دراستها على ضوء أحكام العهد الدولي الخاص بالحقوق المدنية والسياسية وكذا الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري، اللذان يشكلان مرجعاً في التحرك قدماً عند مواجهة مسائل من هذا القبيل. كما تسعى هذه الدراسة إلى تقييم آلية المرصد الوطني للوقاية من التمييز وخطاب الكراهية المستحدث بموجب القانون الجديد ومدى استجابته لمبادئ باريس التوجيهية بخصوص المؤسسات الوطنية لحقوق الانسان. This study focuses on law No. 20/05 issued in 28/04/2020, which prevents and fights against discrimination and hate speech. There is no room for doubt that the undertaking of this issue is closely related to the international human rights instruments to which Algeria belongs to. So we aimed to study it within the framework of the provisions of the International Covenant on Civil and Political Rights as well as the International Convention on the Elimination of All Forms of Racial Discrimination, which constitute a reference in moving forward when facing issues like this. This study also seeks to evaluate the mechanism of the National Observatory for the Prevention of Discrimination and Hateful Discourse developed under the new law and its correspondence to the Paris Guidelines regarding national human rights institutions.
