المسؤولية الدولية لمخالفة الاحتلال الإسرائيلي لقواعد القانون الدولي الإنساني

Abstract

لقد بلغت الإنتهاكات الإسرائيلية حدا من الفظاعة التي لا يمكن تجاوزها أو التغافل عنها ولا يمكن للعالم أن يبقى متفرجا عما يفعله هذا العدو الغاشم بالشعب الفلسطيني عامة وسكان غزه خاصة، فإن دراستنا هذه تخص المسؤولية الدولية لمخالفة الإحتلال الإسرائيلي لقواعد القانون الدولي الإنساني وحاولنا إبراز موقف الفقه الإسلامي، وللخوض في هذا الموضوع نطرح الإشكالية الآتية "إلى أي مدى يتحمل الاحتلال الإسرائيلي المسؤولية الدولية عن انتهاك القانون الدولي الإنساني في الأراضي الفلسطينية"؟ وللإجابة على الإشكالية المطروحة، تطرقنا إلى مفهوم المسؤولية الدولية وأساسها في الفقه الإسلامي والقانون الدولي، وقد ذكرنا أهم المحطات التي مرت بها القضية الفلسطينية من خلال مراحلها التاريخية ضد الاحتلال الإسرائيلي، كما حددنا بعض الانتهاكات الواقعة ضد ضحايا والأعيان المدنية وغيرها في النزاعات المسلحةـ، مع تسليط الضوء على قواعد الحماية الدولية لهذه الفئات التي شملها القانون الدولي الإنساني، مع الإشارة إلى موقف الفقه الإسلامي من ذلك، ثم بينا بعض الآليات الشرعية والقانونية لمحاكمة مجرمي الحرب الإسرائيليين وتحديد مسؤولياتهم، وفي الأخير من أهم النتائج المتوصل اليها أن المسؤولية الدولية للإحتلال الإسرائيلي على جرائمه حتى لو كانت في الأصل قائمة على عاتقه إلا أنها في هذه الحالة لا تقوم إلا إذا تمت محاكمته من طرف الجهات المسؤولة. Israeli violations have reached a level of atrocity that cannot be overlooked or overlooked, and the world cannot remain a spectator of what this brutal enemy is doing to the Palestinian people in general and to the residents of Gaza in particular. This study addresses international responsibility for the Israeli occupation’s violation of the rules of international humanitarian law, and we have tried to shed light on the position of Islamic jurisprudence. To delve deeper into this topic, we raise the following problem: “To what extent does the Israeli occupation bear international responsibility for violating international humanitarian law in the Palestinian territories”? To answer the problem at hand, we touched on the concept of international responsibility and its basis in Islamic jurisprudence and international law. We mentioned the most important stations that the Palestinian cause went through during its historical stages against the Israeli occupation. We also identified some violations committed against victims, civilian objects, and others in armed conflicts, highlighting the rules of international protection for these groups covered by international humanitarian law, and explaining the position of Islamic jurisprudence on that. Then we explained some of the legitimate and legal mechanisms for prosecuting Israeli war criminals and determining their responsibilities. Finally, one of the most important results reached is that the international responsibility of the Israeli occupation for its crimes exists, even if it exists at all.
