نطاق ممارسة حرية الرأي في الفقه الإسلامي والقانون الجزائري

Abstract

"يدرس هذا البحث نطاق ممارسة حرية الرأي بين الفقه الإسلامي والقانون الجزائري فبعد شرح الحدود والمصطلحات من الناحية اللغوية والشرعية والقانونية تطرقت لإيجابيات وسلبيات حرية الرأي، كما عددت مجالات ومظاهر هاته الحرية لكن هاته المجالات والمظاهر ليست على إطلاقها بل مقيدة بمجموعة من الحدود الشرعية والقانونية كي لا يتعسف الأفراد ويفرطوا في استخدامها ويعتدوا على حريات غيرهم كما تم التطرق إلى آليات ووسائل حماية هاته الحرية لضمانها وصونها وحفظها . وأهم نتيجة خلص إليها البحث هو اتفاق القانون الجزائري والشريعة الإسلامية في حمايتها لحرية التعبير عن الرأي مع اختلاف بين النظامين، حيث يرى القانون أن ذلك مجرد حق تقوم به الدولة دون طابع الإلزام بينما تراه الشريعة أكثر من واجب ينبغي حمايته والقيام به من خلال ما يسمى بالأمر بالمعروف والنهي عن المنكر. " " This research examines the freedom of speech between the Islamic jurisprudence and the Algerian law , after explaining the boundaries and the terminology from linguistic, legal and religious aspects .We mentioned the pros and the cons of practicing the freedom of speech. It also enumerated the aspects of this freedom, the last are not absolute but restricted by a set of legal and religious limits, so as not to arbitrariness by the individuals in their use and to respect the freedoms of others. We also discussed the mechanisms and means of protecting this freedom to ensure, and preserve it. The conclusion of this research is agreement of the Algerian law and the Islamic law in its protection of the freedom of speech with the difference between the two systems, the law considers that this is a right that the state does without obligation, while the Shari 'a sees it as an obligation that should be protected by ( Enjoining good and forbidding wrong).
