جريمة تعاطي المخذرات دراسة مقانة بين الشريعة الإسلامية والقانون الجزائري

Abstract

" تعتبر المخدرات مواد كيميائيةً ضارةً بجسم الإنسان، وتتعدد أصنافها وأنواعها فمنها الهرويين والكوكايين والأفيون وغيرها، وقد تناولها الإنسان منذ القدم وحتى وقتنا هذا، متذرعاً بالنشوة التي يحصل عليها من جرائها، بالإضافة إلى الهروب من الواقع التعيس والمؤلم، رغم احتوائها على مواد ضارة وسامة بجسمه. ويكثر انتشار هذه المواد في وقتنا الراهن بين فئات المجتمع المختلفة صغاراً وكباراً ، رجالا ونساءً، وللمخدرات تأثيرات سلبية على حياة البشر سواء على الصّعيد النفّسي أو الصّحي أو الاجتماعي. ولقد نصت الشريعة الإسلامية على تحريم هذه الجريمة لما فيها من أضرار على الكليات الخمس. وقد عالج المشرّع الجزائري ذلك بسنه القانون 04 / 18 مؤرخ 13 ذي القعدة عام 1425ه الموافق ل: 25 ديسمبر سنة 2004 يتعلق بالوقاية من المخدرات والمؤثرات العقلية وقمع الاستعمال والاتجار غير المشروعين بها. "" This research deals with a summary of a book on objective interpretation untitled with the objective interpretation of Mustafa Muslim. In this research, we seek to give a brief translation of the author and his book. We discussed the definition of the objective interpretation in all its aspects, according to the author’s arrangement of his book. The most important thing that we dealt with is the subject of the science of occasion and its appearance and what is written in it. Then we mentioned the first example, which was a model in the objective study represented in the divinity in the Holy Qur’an and the facts associated with it, with mentioning the most prominent evidence in the case of inference coming to the last point, which is the second applied example in Surat Al-Kahf and its interpretation objectively, given that this Surah guides to the dissemination of values. Perhaps the most important finding from this research is that this book is an important reference in the study of objective interpretation due to the interest of its author in this type of interpretation.
