Abstract

ملخّص البحث يندرج هذا العمل ضمن فنِّ تحقيق مخطوطات التراث الإسلامي، ويرمي إلى إخراج جزء من كتاب الإمام أبي عمران المازوني الموسوم : "" تحلية الذهب في علم القضاء والأدبفيما بين اللوحتين ] 100 [ و] 109 [الذي لم يَسْبقْ أن تمَّ نشره أو طباعته حسب اطّلاعنا، ويحَاوَلُ توثيقُه في أقرب صورة كما أراده المؤلف. ويَتقدمُ تحقيقَ الكتاب قسمٌ دراسيّ يتضمَّنُ عرضاً مختصراً لسيرة المؤلف، ولأوضاع عصره، ووصفا عاما للكتاب، وبيانا لمنهج مؤلفه فيه. أما قسم التحقيق ففيه كتابة النص المحقق كاملا وفق قواعد الإملاء الحديثة، مع توثيق ما يمكن توثيقه، والتعليق على ما يحتاج إلى تعليق. وخلص البحث إلى نتائج أهمها أن القاضيَ أبا عمران المازوني كان من كبار أعلام الفقه المالكيّ في عصره، وأنَّ كتابه هذا يتميزُ بكونه سفرا في باب النوازل التي أُجيب عليها استنادا إلى ما يتضمنه الفقه المالكي من قواعد رصينة، كما أوصى بضرورة الاهتمام بتحقيق مخطوطات النوازل المالكية لما فيها من تراث أصيل جمّ. Summary This research comes within the art of investigating manuscripts of Islamic heritage, and aims to produce a part of book called: Tahliyat-u-dhahab fi 'Ilm al qadha' w-l'adab, who is authored by Scholar-judge: Abu 'Imran Almazuny, from page: [100], to page:[109], that has never been published or printed – as far as we know - , and tries to document it in the closest image to what the author wanted it to be. The investigation of this part of the book is preceded by a study section that includes a brief study of the author's life and the era in which he lived, it contains a general description of the book, and a statement of his author's approach. As for the investigation section, it includes writing the entire investigated text of the according to modern spelling rules, documenting what can be documented, and commenting on what needs to be commented. The research concluded with a conclusion of the most important results. Including that the assessor judge, Almazuni, is one of the prominent figures in the Maliki jurisprudence in his time, and the distinction of this book is that it about: the new incidents fatwa's , which has been answered according to the disciplined rules of the Maliki jurisprudence. Also, he recommended the necessity of paying importance to the investigation of the manuscripts of the new incidents fatwa's in Maliki jurisprudence, due to their rich and original scientific heritage.
