Abstract

"البحث بعنوان ""الطرق الشرعيّة لمعالجة الخلافات الزوجية وسبل حلّها دراسة فقهية مقاصدية""؛ وهو يبحث في المسالك المشروعة في دين الله؛ التي يمكن للأزواج اتباعها لحل خلافاتهم الزوجية، وفق رؤية فقهية مقاصدية. وهذا الموضوع موزع على أربعة مباحث وخاتمة؛ حيث تطرقت في المبحث الأول إلى ماهية الخلافات الزوجية وأسبابها. وفي المبحث الثاني تعرضت إلى هدي النبي صلى الله عليه وسلم في معالجة الخلافات الزوجية، والسبل الشرعيّة لحل خلافات عيوب الزوجين. والمبحث الثالث تناولت فيه تعريف النشوز، وأقسامه، وأماراته، وطرق معالجته ومقاصدها. والمبحث الرابع ذكرت فيه الطرق القضائية لعلاج الخلافات الزوجية وهي بعث الحكمين، والخلع، والتفريق القضائي بالطلاق أو الفسخ. وخاتمة المباحث نتائج و توصيات، وأهم نتيجة توصلت إليها في البحث هي: هدي النبي صلى الله عليه وسلم هو البلسم الشافي لكثير من الخلافات الزوجية. The research is entitled “Legitimate ways of addressing marital disputes and ways of resolving them, an intentional jurisprudential study.” It examines the legitimate paths in the religion of God that husbands can follow to resolve their marital disputes, according to an intentional jurisprudential visionThis topic is divided into four sections and a conclusion. Where she touched in the first section on the nature of marital disputes and their causes. In the second topic, I was exposed to the guidance of the Prophet, may God bless him and grant him peace, in dealing with marital disputes, and the legal ways to resolve disputes and defects of spouses. The third topic dealt with the definition of nushuz, its divisions, signs, methods of treating it and its purposes. And the fourth topic, in which the judicial methods of dealing with marital disputes are mentioned, which are sending the two judgments, khul’, and judicial differentiation by divorce or annulment. And the conclusion of the investigations findings and recommendations, and the most important result reached in the research are: The guidance of the Prophet, may God bless him and grant him peace, is the healing balm for many marital disputes.
