اختيارات الشوكاني الاصولية من خلال كتابه ارشاد الفحول باب الاجتهاد

Abstract

تهدف هذه الدراسة إلى الكشف عن الاختيارات الأصولية للإمام محمد بن علي الشوكاني من خلال كتابه الأصولي الشهير "إرشاد الفحول إلى تحقيق الحق من علم الأصول" وقد اخترنا باب الاجتهاد أنموذجا للدراسة وكانت الإشكالية الأساسية للبحث هي: مدى اعتبار آراء الشوكاني واختياراته في باب الاجتهاد خصوصا وأبواب أصول الفقه عموما من خلال كتابه ""إرشاد الفحول""، وما أثر ذلك في تقريراته وتنزيلاته الفقهية ؟. وللإجابة على ذلك تناولنا في الفصل الأول التعريف بالإمام الشوكاني وكتابه ""إرشاد الفحول""، أما الفصل الثاني فخص للاجتهاد عند الإمام الشوكاني واختياراته. وقد خلصت الدراسة إلى جملة من النتائج أبرزها: أن الشوكاني يرى أن الاجتهاد با ومفتوح، وأنه لا يجوز إغلاق بابه، وعارض التقليد، واعتبره تعطيلا للعقل الفقهي This study aims to reveal the fundamental choices of Imam Muhammad bin Ali Al -Shawkani through his famous fundamentalist book ""Guidance Alfouhoul What is the impact of this in his jurisprudential reports and downloads ? To answer this, we have had in the first chapter the definition of Imam Al -Shawkani and his book ""guidance Alfouhoul"". But for the second chapter, it is devoted to diligence at the Imam Al -Shawkani and his choices. The study concluded with a number of results, most notably: In the view of Al -Shawkani, ijtihad remains and is open and that it is not permissible to close his door and oppose the tradition and considered it an obstruct of the juristic mind."
