أثر تقنين الفقه الإسلامي على حرية الاجتهاد

Abstract

اتسم الاجتهاد في الفكر الإسلامي بالإبداع والتنوع، ومسايرة الأحداث والمتغيرات وهو دليل صلاحية الشريعة الغراء لكل زمان ومكان، اهتم علماؤنا به ووضعوا له شروطا، من بينها حرية المجتهد في عمله على استنباط الأحكام الشرعية فلا يتقيد برأي ولا يلتزم إلا بقواعد الاجتهاد وهو أمر تغيرت معالمه في مختلف الأدوار التي مر بها الفقه الإسلامي بلغ أوجه في عصور الأولى وانحصرت فعاليته في عصر التقليد،حين مس الفكر الاسلامي الجمود . مع ذلك لم يخل عصر من علماء عملوا على بث التجديد وبعث الحياة فيه، وفي عصر النهضة تم اعتماد التقنين أداة لتفعيل تطبيق الشريعة الاسلامية، من خلال صب أحكام الفقه الإسلامي في قالب القوانين سعى من خلاله العاملون عليها إلى جعل أحكام الفقه الاسلامي موضع التطبيق. ثم إن البحث في تقنين الفقه الإسلامي أظهر مواقف متباينة، بين مؤيد ومعارض لاعتماده وسيلة لتطبيق الشريعة الاسلامية ذلك أن الاجتهاد يقوم على الحرية بينما يتسم التقنين بالإلزام وتحديد حكم في نص. Abstract : El IJTIHED was characterized by creativity and diversity, that prouve the validity of sharia for all the times and the places, which our scientists took care of and set conditions for, including the freedom of the scientist in his work, he does not abide by an opinion and adheres only to the rules of Islamic jurisprudence, which changed its features in the various roles. However, the Renaissance time in history of Islamic jurisprudence was adopted as a tool to activate the application of Islamic law, by writing it into the form of laws (codification) through which its workers sought to make the provisions of Islamic jurisprudence applicable. Moreover, research into codification of Islamic jurisprudence has shown differing positions, between supporters and opponents of its adoption as a means of applying Islamic law, as El IJTIHED is based on freedom while codification is binding and a provision is defined in a text
