الاختيارات الفقهية لابن رشد الحفيد (ت 595هـ) من خلال كتابه بداية المجتهد ونهاية المقتصد "كتاب الطلاق أُنموذجاً"

Abstract

الملخص: يقوم هذا البحث بدراسة الاختيارات الفقهية لابن رشد الحفيد المالكي (595ه)، معالجا مسائل من كتاب الطلاق، من خلال كتابه بداية المجتهد ونهاية المقتصد. وتضمن مقدمة وثلاثة مباحث وخاتمة، حيث خصص المبحث الأول بالتعريف بابن رشد الحفيد و بكتابه ثم التعريف بالاختيارات الفقهية ، أما المبحث الثاني فخصصته لدراسة مسائل متعلقة بأنواع الطلاق وأركانه، أما المبحث الثالث فقد خصصته لدراسة مسائل متعلقة بالرجعة وأحكام المطلقات، وقد خلص هذا البحث إلى جملة من النتائج أهمها أن ابن رشد الحفيد لم يكن متعصبا ، ولامقلد لمذهبه المالكي‘ بل كان يتحرى الصواب، ويظهر ذلك من خلال تنوع استدلالاته، ومخالفته في جل المسائل لمذهبه.This research examines the jurisprudential choices of IbnRushd al-Malki al-Maliki (595 AH), addressing issues from the book of divorce, through his book the beginning of the diligent and the end of the prudent. The second section was devoted to the study of issues related to the types and types of divorce. The third topic is devoted to the study of questions related to the return and the provisions of divorced women. One of the most important results is that IbnRushd's grandson was not fanatic, and imitating his approach to Maliki ', but was investigating the right, and this is shown through the diversity of his reasoning, and the violation of most of the issues of his doctrine
