حق المستهلك في العدول عن العقد الإلكتروني

Abstract

الملخص: من أهم المشكلات المعاصرة التي تواجه المستهلك اليوم تلك المتعلقة بالمعاملات الإلكترونية لفئة المستهلكين عبر الانترنت في إطار ما بات يعرف بالعقد الإلكتروني الذي يعد أهم وسيلة من وسائل التجارة الإلكترونية التي عادة ما يصاحب عرض السلع أو الخدمات في هذه السوق عبر الانترنت الكثير من المبالغة في الدعاية، ما يجعل هذا الأمر يؤثر بشكل واسع على توجه المستهلك، وقد يوقعه في مغالطة تضر بمصالحه. فما هي الحماية التي قررها المشرع الجزائري والتشريعات المقارنة في سبيل توفير ضمانات أكثر للمستهلك الإلكتروني كي يكون على بينة من أمره، قبل وبعد إبرام العقد، باعتبار أن وسيلة التعاقد عبر الانترنت لا تمكن المستهلك من معاينة السلعة أو التعرف على الخدمة عن قرب؟ هذه الأسئلة نحاول الإجابة عنها من خلال التطرق إلى الحق في الرجوع، أو كما يسميه البعض الحق في العدول عن العقد الإلكتروني وتكييفه القانوني ومجال تطبيقه وآثار ممارسته بالنسبة للمورد الإلكتروني والمستهلك. Abstract: One of the most important contemporary problems facing the consumer today are those related to electronic transactions made online, forming what is known as the Electronic Contract which is the most important means of e-commerce. In this type of commerce, theoffer of goods or services onlineis usually accompanied by exaggerated advertisement, which influences the consumer's orientations. So what protection is set by different legislations to provide more assurance to the electronic consumer and guarantee his awareness before and after the conclusion of the contract? Especially that the consumer is unable to identify the online service closely? We try to answer these questions are by addressing the right to opt out of the electronic contract, its legal adaptation, the scope of its application and itseffectsfor the electronic supplier and the consumer.
