النظام القانوني للسلطة العليا للشفافية والوقاية من الفساد ومكافحته

Abstract

في إطار الوقاية من الفساد ومكافحته قام المشرع الجزائري بعد المصادقة على الاتفاقيات الدولية باستحداث هيئة مستقلة تتمثل في السلطة العليا للشفافية والوقاية من الفساد ومكافحته لها عدة مهام وصلاحية اتخاذ عدة تدابير تسعى من خلالها للقضاء على جرائم الفساد أو الحد منها ولتكريس استقلالية هذه الهيئة نص عليها في أسمى قانون في البلاد وهو الدستور، حيث تقوم هذه الهيئة بمراقبة جميع المؤسسات. كما تقوم بإخطار السلطة القضائية كلما اكتشفت وقائع ذات صبغة جزائية بالإضافة إلى مهام أخرى سنناقشها في هذا المقال. Abstract: As regards preventing and fighting corruption and right after ratifying international conventions related to this matter, the Algerian legislator had created an independent institution called "the Supreme Authority for Transparency, Prevention, and fight against Corruption" that has several functions through which it is sought to eliminate or limit corruption crimes and to ensure its independence it was stipulated in the supreme law in the country, which is the constitution. This authority monitors all institutions and notifies the judiciary whenever it unveils facts of a criminal nature, in addition to other functions that we will discuss in this article.
