دور أحكام الطلاق في حماية الأسرة من التفكك في الفقه الإسلامي وقانون الأسرة الجزائري

Abstract

" تناولت هذه الدراسة إشكالية مهمة وهي: ""ما مدى أهمية تطبيق أحكام الطلاق وأثرها في حماية الأسرة من التفكك في الفقه الإسلامي وقانون الأسرة الجزائري"". ولقد توصلنا إلى أنّ تقيد والتزام كلا الزوجين بما أوجبه الله عليهما من أحكام الطلاق يكون أحد الوسائل المهمة في تجنيب الأسرة التفكك، كما أنّ الشريعة الإسلامية قد أحاطت الأسرة بتدابير وقائية حتى قبل الزواج، كاختيار الزوج، لما له من أهمية بالغة للالتزام والتقيد بأحكام الطلاق، كما أنّ اختلاف الفقهاء في وقوع الطلاق من عدمه له أثر إيجابي في الحفاظ على الأسرة وللتأكيد على هذا الأمر أظهرت لنا الدراسة الميدانية أنّ أغلب حالات الطلاق كانت بسبب جهل الزوجان بأحكام الطلاق وهو من الأسباب الرئيسية لانحلال العلاقة الزوجية.
