التطبيقات المعاصرة فى فقه الزكاة (صندوق الزكاة بالجزائر نموذجا)

Abstract

الملخص: هذا الموضوع ' التطبيقات المعاصرة للزكاة صندوق الزكاة في الجزائر -نموذجا-'وتبحث هذه الدراسة على نماذج للتطبيقات المعاصرة للزكاة، فما مدى جواز استثمار اموال الزكاة؟ وكيف يمكن لهذا التمويل الإسلامي ان يعمل على تخفيض نسبة الفقر. اجابت الدراسة على ذلك من خلال اربعة مباحث: المبحث الاول خصصته للتعريف بالزكاة وبيان حكمها وأدلة الحكم مع ذكر مصارفها الثمانية. أما المبحث الثاني: فقد جعلته لمعرفة حكم استثمار اموال الزكاة ورجحت فيه قول المجزين لذلك، وفى الجانب التطبيقي عنيت في المبحث الثالث : ببيان دوافع انشاء مؤسسات الزكاة في الدول العربية والإسلامية وأخذت نموذجين على ذلك بيت الزكاة الكويتى، وصندوق الزكاة اللبنانى، أما المبحث الرابع والأخير سلطت فيه الضوء على صندوق الزكاة الجزائري مفهومه ، نشأته وكيفية ادارته ،وطرق تحصيل الزكاة ، والإحصائيات العامة لمداخيل الزكاة العامة وزكاة الفطر وبعض المشاريع الاستثمارية للسنوات العشر الأخيرة وذكرت بعض الإنجازات كما تسنى لي التحدث على العراقيل والصعوبات التي واجهت الصندوق ولا زالت ، ثم ذكرت الاهداف والغايات والآفاق المرجو تحقيقها ان على المستوى القريب او المتوسط والبعيد. توصلت الدراسة الى جملة من النتائج والتوصيات لعل من اهمها هو الانتقال من الطرق الموروثة في جمع وتحصيل الزكاة وصرفها الى الدور المؤسسي لفريضة الزكاة والتطبيقات المعاصرة في ذلك كما امكن بيان اهداف الزكاة وأثارها في حياة المجتمع المسلم، وحل مشكلاته كالفقر والتشرد والبطالة...الخ. ومن اهم التوصيات المتوصل اليها العمل على غرس الثقة بين مؤسسة صندوق الزكاة وكذا المزكين مع بيان واضحة لكيفية تحصيل الاموال وصرفها وتحديث الوسائل المستخدمة في ذلك بالاستعانة بالوسائل التكنولوجية الحديثة This topic examines contemporary models of zakat, the extent to which it is permissible to invest zakat funds, and how this Islamic financing can reduce the poverty rate. The study answered this through four questions: The first topic was devoted to the definition of Zakat and the statement of its ruling and the evidence of the provision with the eight banks. In the third aspect, the motive of establishing zakat institutions in the Arab and Islamic countries. Two examples were the Zakat House of Kuwait and the Lebanese Zakat Fund, while the fourth and final research was done in it. Highlighting the Algerian Zakat Fund, its concept, how it is managed, how Zakat is collected, the general statistics of Zakat receipts, Zakat Al-Fitr and some investment projects for the past 10 years. I also mentioned some achievements and I was able to talk about obstacles and difficulties. The Fund addressed and continues, and then mentioned the goals, objectives and prospects to be achieved at the near, medium and long term. The study reached a number of conclusions and recommendations. Perhaps the most important of these is the transfer from inherited methods of collection and collection of zakat to the institutional role of Zakat and contemporary applications in this regard. It is also possible to explain the objectives of zakat and its effects in the life of the Muslim community and solve problems such as poverty, homelessness, . One of the most important recommendations is to work on instilling trust between the Zakat Fund and the Ministry of Finance, with a clear statement of how to collect and exchange the money and modernize the means used by using modern technological means
