Abstract

يتناول هذا البحث دراسة للقاعدة الفقهية"الضرر يزال" وتطبيقاتها في المعاملات المالية المعاصرة, وكان حق الإبتكار والعلامة والاسم التجاري وحق المؤلِف نماذج الدراسة, وقد أجابت الدراسة على عدة إشكالات، أهمها عن خلاف العلماء في مالية العلامة والاسم التجارى وغيرها، وما مدى توظيف قاعدة "الضرر يزال" في مسائل المعاملات المالية المعاصرة؟ وما أثر ذلك في بعض النوازل؟ .This research deals with a study of the jurisprudential rule “removing the harm” and its applications in the contemporary financial transactions. The models of the study were the right of innovation, the trademark, the trade name and the author’s rights. The study answered several problems, the most important are the scholars’ disagreement over the finances of the brand and the trade name, etc., as well as the extent of using “removing the harm” rule in the issues of contemporary financial transactions? What is the effect of this on some controversial issues?
