عقد التىريد وأحكامه في الفقه الإسلامي -دراسة فقهية مقارنة-

Abstract

تناكلت المذكرة مكضكع عقد التكريد في الفقو الإسلبمي د ا رسة مقارنة, فمكضكع البحث يتعمؽ بعقد مي تحتاج إليو كؿ المجتمعات الإسلبمية كالغير إسلبمية, فيدفت ىذه المذكرة إلى بياف مدل اعتبار العمماء ليذا العقد كبياف مشركعيتو. احتكت ىذه المذكرة ثلبثة مباحث ككؿ مبحث يحتكم عمى ثلبثة مطالب. كميدنا الد ا رسة في المبحث الأكؿ بتعريؼ عقد التكريد في المغة كالاصطلبح كالفرؽ بينو كبيف غيره مف العقكد ث انتقمنا لمحديث عف أركاف عقد التكريد كشركطو كأقسامو. ث بينا في المبحث الثاني صكر عقد التكريد كأغ ا رضو كالطريقة التي يت بيا. ث انتقمنا إلى المبحث الثالث كالذم بينا فيو التكييؼ الفقيي لمعمماء لعقد التكريد كأقكالي كأدلتي كمناقشة أدلتي كالترجيح بينيا. كفي النياية تكجت الد ا رسة بخاتمة كالتي ذكرنا فييا أى ما تكصمنا إليو مف نتائج كالتي مف أىميا أف عقد التكريد ىك عقد جديد كليس عقد تابع لمعقكد القديمة كاف شابييا في بعض الأكصاؼ كأنو عقد جائز كاف ط أ رت عميو عدة شبيات كاشكالات فيك لا يتضمنيا كاف تضمنيا فمسمكح بيا نظ ا ر لحاجة الناس إليو الشديدة في ىذا العصر. Abstract The message dealt with the subject of the supply contract in Islamic jurisprudence, comparative study, The subject of search terms of an important contract in the community, was held supply need all the Islamic and non-Islamic societies, this letter aimed to the statement of the extent to which scientists of this contract and the statement of its legitimacy. This message was contained three sections and each section contains three demands.
