آداب الرد العلمي في النوازل الفقهية، رد ابن مرزوق التلمساني(ت: 842هـ) على الغبريني(ت: 772 هـ) نموذجا

Abstract

إن المقصود من الردود العلمية هو الأخذ بيد المردود عليه إلى الصواب بما يراه الرادُّ من وجهة نظره؛ ومن أبرز العلماء التلمسانيين الذين اهتموا بالفقه ونوازله والردود، الشريف التلمساني والمقري وابن مرزوق. وبعد قراءتي لما كتبه العالم أبو العباس أحمد بن يحيى الونشريسي المتوفى سنة 914هـ في كتابه الفذ (المعيار المعرب)؛ وبالتحديد في فصل (فتوى التلمسانِيَّيْنِ الشريف والمَقَرِّي فيمن أوصى بثلث ماله واشترط أنه لا يرجع في وصيته ورد الغبريني عليهما وانتصار ابن مرزوق لهما) انقدح في ذهني كتابة هذا المقال المعنون بــ(آداب الرد العلمي في النوازل الفقهية، رد ابن مرزوق على الغبريني أنموذجا). والهدف من هذه الورقة البحثية إبراز تحلي علمائنا المالكية بآداب الرد العلمي، ومن أهم نتائجه أن يتربى الجيل المعاصر على تلكم الآداب التي اتصف بها علماء الأمة في مجال الردود العلمية والاختلافات الفقهية. Abstract : What is meant by scientific responses is to take the respondent’s hand to what is correct according to what the respondent sees from his point of view. Among the most prominent Tlemcenian scholars who were concerned with jurisprudence, its issues and responses, is Alchirif Tlemceni, Almakari, and Ibn Marzouk, specifically, in the chapter “The Fatwa of the Tlemcenians, Alchirif and Almakari, who bequeathed one-third of his money and stipulated that he does not return to his will, Al-Ghubrini’s response to them and Ibn Marzouk’s victory for them” sparked my mind to write this article entitled (Ethics of the scientific response in jurisprudential calamities, Ibn Marzouk response to Al-Ghubrini as a model). The main goal of this research paper is to highlight the embodiment of our Maliki scholars with the etiquette of scientific response, and one of its most important results is that the contemporary generation is brought up on those manners that characterize the nation’s scholars in the field of scientific responses and jurisprudential differences.
