أحكام الصداق في الفقه المالكي

Abstract

الزواج ككل عقد ينشأ من مجموعة من الحقوق، منيا حقوق مالية وغير مالية بين الزوجين، ومن ضمن ىذه الحقوق التي تستحقيا الزوجة عمى زوجيا، حق المير، وى ومحل د ا رستنا وذلك بإعطاء نظرة شاممة عنو في المذىب المالكي. إذ تناولنا في مطمع البحث التعريف بمصطمحات البحث كمبحث تمييدي، وأربعة مباحث يحتوي كل مبحث منيا عمى ثلاث مطالب، جاء في المبحث الأول تعريف الصداق والحكمة من تشريعو وحكمو، بينما المبحث الثاني عن شروطو ومقداره وأنواعو، أما المبحث الثالث تناولنا فيو جميع أنواعو وحالات وجوب كل نوع، وصاحب الحق في المير لقبضو، وما يترتب عنو وكيفية تعجيمو وتأجيمو ومتى يمحق المير من زيادة ونقصان وتصنيف، أما بخصوص المبحث الأخير فكان عبارة عن د ا رسة بعض المسائل المتعمقة بالصداق، كمسألة تجيي زمتاع البيت، وكذلك مير السر ومير العلانية، ومسألة التغالي في الميور. Abstract in inglish Marriage as a whole thing arises from a range of rights, including financial and non-financial rights between spouses, and within those rights that they deserve a wife to her husband, the right to a dowry that .is our study by giving an overview about the Maliki school.
