بيع الدين و صوره المعاصرة

Abstract

الإنسان معرض في معاملاته التجارية وغيرها للإدانة والاستدانة من غيره، وقد يحتاج إلى التصرف في هذا الدين بالبيع والشراء بطرق وصور شتى، لكن هل هذه التصرفات متوافقة مع مبادئ الشريعة الإسلامية ؟ فهذا ما سنحاول معرفته من خلال هذا البحث المتواضع الموسوم بــ "بيع الدين وصوره المعاصرة".لذا جاء في مبحثين الأول وضحت فيه ماهية بيع الدين من خلال تعريفه وصوره القديمة في الفقه الإسلامي التي قسمها الفقهاء إلى بيع الدين للمدين وبيعه لغيره، وقد يكون مؤجلا المجمع على حرمته لأنه بيع الكالئ بالكالئ، أوحالا المجاز بشروط، ثم ذكرت علاقته ببعض العقود وما ترتب عنه من أثر، وانتقلت في المبحث الثاني إلى الحديث عن بعض الصور المعاصرة وتكييفاتها الفقهية الجائزة منها (بيع الأوراق التجارية)، وغير الجائزة (خصم الأوراق التجارية، عقد التوريد، العقود المستقبلية، التوريق)، كما ذكرت بعض ما اقترحه المتخصصون كبدائل شرعية للصور غير الجائزة منها، كالقرض الحسن والسلم والاستصناع.
